Portfolio Analysis
We begin by conducting a rigorous enforcement-focused analysis of a client's patent portfolio to determine which assets are realistically monetizable. This assessment combines traditional legal analysis with proprietary, internally developed analytical tools designed to identify commercially relevant technologies, likely infringement scenarios, and viable enforcement pathways. The result is a disciplined shortlist of patents suitable for licensing or enforcement, grounded in both legal merit and market reality.
Strategic Licensing
For patents that warrant action, we pursue targeted, pre-suit licensing efforts designed to resolve disputes without litigation. Using claim-specific infringement theories informed by our internal analysis, we prepare and send carefully calibrated demand letters and engage directly with in-house and outside counsel to negotiate licenses. Our approach emphasizes precision, credibility, and commercial realism, with the objective of achieving durable resolutions while preserving strategic optionality.
Patent Enforcement
When licensing efforts do not lead to resolution, we advise clients on whether and how to pursue patent enforcement through litigation. This includes evaluating venue, timing, cost, and strategic leverage, as well as coordinating with co-counsel or litigation funding where appropriate. Litigation is pursued selectively and deliberately, not as a default outcome, but as a backstop that gives credibility to licensing efforts and protects the client's long-term enforcement position.
